style=\"font-weight: 400;\"> es un contrato de prestaci\u00f3n de servicios, para qu\u00e9 sirve y <\/span><span style=\"font-weight: 400;\">cu\u00e1les son<\/span><span style=\"font-weight: 400;\"> prestaci\u00f3n de servicios<\/b><span style=\"font-weight: 400;\"> es un documento <\/span><span style=\"font-weight: 400;\">por<\/span><span style=\"font-weight: 400;\"> el <\/span><span style=\"font-weight: 400;\">que<\/span><span style=\"font-weight: 400;\"> una persona <\/span><span style=\"font-weight: 400;\">jur\u00eddica<\/span><span style=\"font-weight: 400;\">,<\/span> <span style=\"font-weight: 400;\">ya sea empresa<\/span><span style=\"font-weight: 400;\"> o profesional <\/span><span style=\"font-weight: 400;\">aut\u00f3nomo, como<\/span><span style=\"font-weight: 400;\"> prestador del servicio<\/span><span style=\"font-weight: 400;\">,<\/span><span style=\"font-weight: 400;\"> se compromete legalmente a llevar a cabo unos determinados servicios para otra empresa o profesional (cliente), a cambio de una retribuci\u00f3n.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A partir del momento en el que se<\/span> <span style=\"font-weight: 400;\">f<\/span><span style=\"font-weight: 400;\">irma este documento, ambas partes quedan obligadas a cumplir las cl\u00e1usulas legales que <\/span><span style=\"font-weight: 400;\">han quedado establecidas<\/span><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Una peculiaridad de este tipo de contratos es que<\/span> <span style=\"font-weight: 400;\">la obra o el servicio objeto del contrato <\/span><span style=\"font-weight: 400;\">tiene que<\/span><span style=\"font-weight: 400;\"> reunir <\/span><b>2 condiciones<\/b><span style=\"font-weight: 400;\">:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tener <\/span><b>autonom\u00eda<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">T<\/span><span style=\"font-weight: 400;\">ener <\/span><b>sustantividad propia<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Esto <\/span><span style=\"font-weight: 400;\">quiere decir<\/span><span style=\"font-weight: 400;\"> que la obra o servicio tiene <\/span><span style=\"font-weight: 400;\">unas<\/span><span style=\"font-weight: 400;\"> caracter\u00edsticas que la hacen <\/span><span style=\"font-weight: 400;\">ser<\/span> <b>independiente de otros trabajos o servicios<\/b><span style=\"font-weight: 400;\"> que <\/span><span style=\"font-weight: 400;\">se est\u00e9n realizando<\/span><span style=\"font-weight: 400;\"> y <\/span><span style=\"font-weight: 400;\">estar<\/span><span style=\"font-weight: 400;\"> separado <\/span><span style=\"font-weight: 400;\">de ellos<\/span><span style=\"font-weight: 400;\">. <\/span><span style=\"font-weight: 400;\">Por lo tanto,<\/span> <span style=\"font-weight: 400;\">esta obra o servicio<\/span> <span style=\"font-weight: 400;\">es algo que est\u00e1 a parte <\/span><span style=\"font-weight: 400;\">de las tareas <\/span><span style=\"font-weight: 400;\">del<\/span><span style=\"font-weight: 400;\"> ciclo productivo permanente de la empresa <\/span><span style=\"font-weight: 400;\">para la que se va a realizar<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2>\u00bfPara qu\u00e9 sirven los contratos de prestaci\u00f3n de servicios?<\/h2>\n<p><span style=\"font-weight: 400;\">Un contrato de prestaci\u00f3n de servicios formaliza<\/span> <span style=\"font-weight: 400;\">una <\/span><b>garant\u00eda <\/b><b>de su cumplimiento<\/b><span style=\"font-weight: 400;\"> que beneficia a <\/span><span style=\"font-weight: 400;\">todas las<\/span><span style=\"font-weight: 400;\"> partes. Por un lado,<\/span> <span style=\"font-weight: 400;\">protege al<\/span> <span style=\"font-weight: 400;\">prestador que se compromete a realizar el servicio, <\/span><span style=\"font-weight: 400;\">y por otro, tambi\u00e9n protege al<\/span><span style=\"font-weight: 400;\"> cliente ante posibles incidencias o incumplimientos de contrato que pudieran producirse.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Por <\/span><span style=\"font-weight: 400;\">eso decimos que<\/span> <span style=\"font-weight: 400;\">la funci\u00f3n de un<\/span> <span style=\"font-weight: 400;\">contrato de prestaci\u00f3n de servicios es proporcionar un <\/span><b>marco <\/b><b>legal<\/b><span style=\"font-weight: 400;\"> y una <\/span><a href=\"https:\/\/www.billin.net\/blog\/inseguridad-juridica\/\" target=\"_blank\" rel=\"noopener\"><b>seguridad jur\u00eddica<\/b><\/a><span style=\"font-weight: 400;\"> a la relaci\u00f3n entre las partes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La utilizaci\u00f3n del<\/span><span style=\"font-weight: 400;\"> contrato de prestaci\u00f3n de servicios es muy habitual en determinados sectores <\/span><span style=\"font-weight: 400;\">que requieren trabajos que empiezan y acaban<\/span><span style=\"font-weight: 400;\"> como:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Fabricaci\u00f3n<\/b><span style=\"font-weight: 400;\">, reparaci\u00f3n, instalaci\u00f3n, mantenimiento, etc.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Profesionales<\/b><span style=\"font-weight: 400;\">, como asesor\u00edas, educaci\u00f3n, servicios inform\u00e1ticos, etc.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Contrataci\u00f3n de personas<\/b><span style=\"font-weight: 400;\">, como los gu\u00edas tur\u00edsticos, animadores, ayuda a domicilio (no se incluye el personal dom\u00e9stico), etc.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Tambi\u00e9n es muy habitual en sectores de telemarketing, limpieza o construcci\u00f3n, <\/span><span style=\"font-weight: 400;\">aunque se corre el riesgo de que surjan<\/span><b> casos de fraude<\/b> <span style=\"font-weight: 400;\">por el uso indebido de esta f\u00f3rmula de contrataci\u00f3n. Veamos por qu\u00e9.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Cuando<\/span> <span style=\"font-weight: 400;\">la actividad principal de la empresa es la realizaci\u00f3n<\/span> <span style=\"font-weight: 400;\">de <\/span><b>servicios <\/b><b>de forma continua<\/b><span style=\"font-weight: 400;\"> y<\/span><span style=\"font-weight: 400;\"> sin una fecha de finalizaci\u00f3n, el contrato de prestaci\u00f3n de servicios<\/span><span style=\"font-weight: 400;\">\u00a0hace que<\/span> <span style=\"font-weight: 400;\">la persona contratada <\/span><span style=\"font-weight: 400;\">trabaje<\/span><span style=\"font-weight: 400;\"> bajo con un <\/span><a href=\"https:\/\/www.billin.net\/blog\/sancionar-contratos-temporales-sin-justificar\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">contrato temporal<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pero lo cierto es que, como<\/span><span style=\"font-weight: 400;\"> est\u00e1 realizando una labor <\/span><span style=\"font-weight: 400;\">que se mantiene en el tiempo,<\/span> <span style=\"font-weight: 400;\">deber\u00eda de tener<\/span><span style=\"font-weight: 400;\"> un contrato indefinido que le permita<\/span> <span style=\"font-weight: 400;\">beneficiarse del derecho a <\/span><b>prestaciones a la finalizaci\u00f3n <\/b><b>del contrato<\/b><b> y otras ventajas<\/b><span style=\"font-weight: 400;\">, <\/span><span style=\"font-weight: 400;\">a las que como temporal no puede acceder.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Por este motivo,<\/span><span style=\"font-weight: 400;\"> el <\/span><a href=\"https:\/\/www.boe.es\/biblioteca_juridica\/anuarios_derecho\/articulo.php?id=ANU-L-2021-00000001182#:~:text=1137%2F2020%2C%20de%2029%20de,de%20obra%20o%20servicio%20determinado.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Tribunal Supremo, en <\/span><span style=\"font-weight: 400;\">la<\/span><span style=\"font-weight: 400;\"> Sentencia 1137\/2020<\/span><\/a><span style=\"font-weight: 400;\">,<\/span><span style=\"font-weight: 400;\"> de 29 de diciembre<\/span><span style=\"font-weight: 400;\">,<\/span><span style=\"font-weight: 400;\"> determin\u00f3 que <\/span><b>el uso del contrato de prestaci\u00f3n de servicios no es aceptable en<\/b> <b>empresas cuya actividad habitual <\/b><b>sea<\/b><b> la<\/b> <b>prestaci\u00f3n de servicios a terceros. <\/b><\/p>\n<h2>Caracter\u00edsticas de un contrato de prestaci\u00f3n de servicios profesionales<\/h2>\n<p><span style=\"font-weight: 400;\">Un contrato de prestaci\u00f3n de servicios <\/span><span style=\"font-weight: 400;\">tiene<\/span> <span style=\"font-weight: 400;\">unas <\/span><b>caracter\u00edsticas propias<\/b><span style=\"font-weight: 400;\"> que <\/span><span style=\"font-weight: 400;\">debemos conocer para utilizarlo de manera correcta y<\/span><span style=\"font-weight: 400;\"> saber<\/span> <span style=\"font-weight: 400;\">sus implicaciones.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Estas caracter\u00edsticas<\/span><span style=\"font-weight: 400;\"> son:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Que el objetivo principal es la regulaci\u00f3n de un servicio <\/span><span style=\"font-weight: 400;\">concreto<\/span><span style=\"font-weight: 400;\"> destinado a alcanzar un fin determinado.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Que la prestaci\u00f3n del servicio debe realizarse de acuerdo a los derechos y obligaciones que se hayan pactado <\/span><span style=\"font-weight: 400;\">entre las partes.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Que el contrato adquiere validez jur\u00eddica <\/span><span style=\"font-weight: 400;\">desde<\/span><span style=\"font-weight: 400;\"> el momento en que se firma.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Que la finalidad del contrato es onerosa, es decir, <\/span><span style=\"font-weight: 400;\">que<\/span><span style=\"font-weight: 400;\"> recibe una compensaci\u00f3n econ\u00f3mica <\/span><span style=\"font-weight: 400;\">por hacer el servicio.<\/span><\/p>\n<h2>Elementos de un contrato de prestaci\u00f3n de servicios entre empresas<\/h2>\n<p><span style=\"font-weight: 400;\">Conociendo ya<\/span><span style=\"font-weight: 400;\"> las caracter\u00edsticas <\/span><span style=\"font-weight: 400;\">de este contrato<\/span><span style=\"font-weight: 400;\">, <\/span><span style=\"font-weight: 400;\">vamos a ver<\/span><span style=\"font-weight: 400;\"> los elementos obligatorios e imprescindibles que debe tener s\u00ed o s\u00ed un contrato de prestaci\u00f3n de servicios entre empresas:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Datos de identificaci\u00f3n<\/b><span style=\"font-weight: 400;\">: <\/span><span style=\"font-weight: 400;\">de las partes implicadas y sus representantes<\/span><span style=\"font-weight: 400;\">,<\/span><span style=\"font-weight: 400;\"> si los hubiera<\/span><span style=\"font-weight: 400;\">:<\/span><span style=\"font-weight: 400;\">,<\/span><span style=\"font-weight: 400;\"> nombre y apellidos o raz\u00f3n social, NIF, domicilio, estado civil, etc.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Forma de actuaci\u00f3n:<\/b><span style=\"font-weight: 400;\"> indicando si las partes act\u00faan en nombre propio o <\/span><span style=\"font-weight: 400;\">est\u00e1n<\/span><span style=\"font-weight: 400;\"> representadas por otras personas o empresas.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Objeto del contrato de prestaci\u00f3n de servicios:<\/b> <span style=\"font-weight: 400;\">hay<\/span><span style=\"font-weight: 400;\"> que especificar<\/span> <span style=\"font-weight: 400;\">las<\/span><span style=\"font-weight: 400;\"> operaciones que se van a <\/span><span style=\"font-weight: 400;\">realizar<\/span><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Duraci\u00f3n del contrato<\/b><span style=\"font-weight: 400;\">: el tiempo que dure o la fecha de finalizaci\u00f3n.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Obligaciones contractuales:<\/b> <span style=\"font-weight: 400;\">las que<\/span><span style=\"font-weight: 400;\"> ambas partes <\/span><span style=\"font-weight: 400;\">deben<\/span><span style=\"font-weight: 400;\"> pactar.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Incumplimientos:<\/b> <span style=\"font-weight: 400;\">especificando cu\u00e1les ser\u00edan<\/span><span style=\"font-weight: 400;\"> las posibles consecuencias en caso de incumplimiento <\/span><span style=\"font-weight: 400;\">de contrato por alguna de las partes<\/span><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Retribuci\u00f3n:<\/b><span style=\"font-weight: 400;\"> el importe <\/span><span style=\"font-weight: 400;\">que se va a pagar<\/span><span style=\"font-weight: 400;\"> por el servicio <\/span><span style=\"font-weight: 400;\">como retribuci\u00f3n<\/span><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Confidencialidad y protecci\u00f3n de datos <\/b><span style=\"font-weight: 400;\">de acuerdo a la LGPD<\/span><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Firmas de los participantes.<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Tambi\u00e9n es recomendable incluir algunas cl\u00e1usulas adicionales que <\/span><span style=\"font-weight: 400;\">proporcionen m\u00e1s informaci\u00f3n y aporten claridad<\/span><span style=\"font-weight: 400;\">, <\/span><span style=\"font-weight: 400;\">como<\/span><span style=\"font-weight: 400;\"> por ejemplo:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">La <\/span><b>ubicaci\u00f3n<\/b><span style=\"font-weight: 400;\">, <\/span><span style=\"font-weight: 400;\">d\u00f3nde<\/span><span style=\"font-weight: 400;\"> se realizar\u00e1 el servicio contratado.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Las <\/span><b>herramientas utilizadas<\/b><span style=\"font-weight: 400;\">:<\/span><span style=\"font-weight: 400;\">,<\/span><span style=\"font-weight: 400;\"> si <\/span><span style=\"font-weight: 400;\">las pone<\/span> <span style=\"font-weight: 400;\">el<\/span> <span style=\"font-weight: 400;\">cliente o el prestador, si son propias o en arrendamiento,<\/span> <span style=\"font-weight: 400;\">qui\u00e9n <\/span><span style=\"font-weight: 400;\">deber\u00eda reponerlas si fuera<\/span><span style=\"font-weight: 400;\"> necesario.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">La forma <\/span><span style=\"font-weight: 400;\">de<\/span><span style=\"font-weight: 400;\"> realizar <\/span><b>reclamaciones<\/b><span style=\"font-weight: 400;\"> sobre el contrato, los plazos para <\/span><span style=\"font-weight: 400;\">hacerlas y d\u00f3nde presentarlas.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">C\u00f3mo se har\u00edan las<\/span> <b>compensaciones o indemnizaciones<\/b><span style=\"font-weight: 400;\"> en caso de incumplimiento de contrato.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Nuestro consejo es que siempre cuente<\/span><span style=\"font-weight: 400;\">s<\/span><span style=\"font-weight: 400;\"> con ayuda especializada. En caso de contratar dos o m\u00e1s de ellos, ser\u00eda conveniente refundir las obligaciones comunes.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><u>Tercero. &#8211; La duraci\u00f3n del contrato<\/u><\/strong><\/p>\n<p>Los servicios y funciones descritos en el pacto anterior se prestar\u00e1n por parte del PROFESIONAL por un plazo inicial de ___________________ meses (desde la firma hasta el 31 de diciembre), que se renovar\u00e1 t\u00e1citamente por periodos anuales, de no mediar preaviso, al menos, con un mes de antelaci\u00f3n a su t\u00e9rmino.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><u>Cuarto. &#8211; Confidencialidad de los datos<\/u><\/strong><\/p>\n<p>El PROFESIONAL se obliga a tratar confidencialmente todos aquellos datos, documentaci\u00f3n y dem\u00e1s informaci\u00f3n que hayan sido suministrados por el CLIENTE durante la vigencia del presente contrato. Adem\u00e1s,<\/span><span style=\"font-weight: 400;\">permite<\/span><span style=\"font-weight: 400;\"> diferenciar 3 bloques de informaci\u00f3n:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>1\u00ba bloque \u2013 identificaci\u00f3n:<\/b> <span style=\"font-weight: 400;\">aqu\u00ed <\/span><span style=\"font-weight: 400;\">queda constancia de los datos identificativos style=\"font-weight: 400;\"> (8\u00ba al 9\u00ba): <\/span><span style=\"font-weight: 400;\">los<\/span><span style=\"font-weight: 400;\"> tipos de conflictos que <\/span><span style=\"font-weight: 400;\">se<\/span><span style=\"font-weight: 400;\"> puedan dar<\/span> <span style=\"font-weight: 400;\">(im<\/span><span style=\"font-weight: 400;\">pago <\/span><span style=\"font-weight: 400;\">del servicio<\/span><span style=\"font-weight: 400;\">, servicio defectuoso o deficiente<\/span><span style=\"font-weight: 400;\">, etc<\/span><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\">)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Referente a la resoluci\u00f3n del contrato<\/b><span style=\"font-weight: 400;\"> (10\u00ba al 13\u00ba): <\/span><span style=\"font-weight: 400;\">es sobre la<\/span><span style=\"font-weight: 400;\"> resoluci\u00f3n y modificaci\u00f3n, qu\u00e9 hacer en caso de conflicto, c\u00f3mo y d\u00f3nde debe resolverse y r\u00e9gimen al que se acogen para ello.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>3\u00ba bloque \u2013 firma:<\/b><span style=\"font-weight: 400;\"> la forma de ratificar y formalizar de manera expresa todo lo acordado es con <\/span><span style=\"font-weight: 400;\">la <\/span><span style=\"font-weight: 400;\">firma <\/span><span style=\"font-weight: 400;\">de<\/span><span style=\"font-weight: 400;\"> las partes.<\/span><\/li>\n<\/ul>\n<h2>\u00bfCu\u00e1nto tiempo puede durar un contrato de prestaci\u00f3n de servicios?<\/h2>\n<p><span style=\"font-weight: 400;\">Como hemos dicho, un contrato de prestaci\u00f3n de servicios es un acuerdo entre profesionales y\/o empresas para la realizaci\u00f3n de un servicio a cambio de una contraprestaci\u00f3n.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Una de las caracter\u00edsticas <\/span><span style=\"font-weight: 400;\">del<\/span><span style=\"font-weight: 400;\"> contrato de prestaci\u00f3n de servicios es <\/span><span style=\"font-weight: 400;\">que tiene<\/span><span style=\"font-weight: 400;\"> una <\/span><b>duraci\u00f3n determinada<\/b><span style=\"font-weight: 400;\">. <\/span><span style=\"font-weight: 400;\">Por ello, como<\/span><span style=\"font-weight: 400;\"> el contrato no puede durar m\u00e1s que la obra o servicio para la que fue contratado<\/span><span style=\"font-weight: 400;\">,<\/span> <span style=\"font-weight: 400;\">se tiene que <\/span><span style=\"font-weight: 400;\">indicar<\/span><span style=\"font-weight: 400;\"> de forma clara y precisa <\/span><span style=\"font-weight: 400;\">cu\u00e1l ser\u00e1 la fecha m\u00e1xima de finalizaci\u00f3n<\/span><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Como hemos <\/span><span style=\"font-weight: 400;\">comentado<\/span><span style=\"font-weight: 400;\"> antes, puede ocurrir que la obra o servicio \u201cno tenga una fecha<\/span> <span style=\"font-weight: 400;\">fin\u201d porque se trata de un servicio continuado. Entonces, <\/span><span style=\"font-weight: 400;\">puesto que<\/span><span style=\"font-weight: 400;\"> parece que el contrato no finalizar\u00e1 nunca, lo que <\/span><span style=\"font-weight: 400;\">se deber\u00eda de <\/span><span style=\"font-weight: 400;\">utilizar <\/span><span style=\"font-weight: 400;\">es<\/span><span style=\"font-weight: 400;\"> un contrato laboral <\/span><span style=\"font-weight: 400;\">para no incurrir en<\/span><span style=\"font-weight: 400;\"> un <\/span><span style=\"font-weight: 400;\">posible<\/span><span style=\"font-weight: 400;\"> fraude.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En<\/span><span style=\"font-weight: 400;\"> el <\/span><a href=\"https:\/\/www.boe.es\/biblioteca_juridica\/abrir_pdf.php?id=PUB-DT-2025-139\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Estatuto de los Trabajadores<\/span><\/a> <span style=\"font-weight: 400;\">se<\/span><span style=\"font-weight: 400;\"> establece que:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Este tipo de<\/span><span style=\"font-weight: 400;\"> contratos no pueden tener una duraci\u00f3n superior a <\/span><span style=\"font-weight: 400;\">tres<\/span><span style=\"font-weight: 400;\">continuamente<\/span><span style=\"font-weight: 400;\"> (volver a firmar otro contrato <\/span><span style=\"font-weight: 400;\">igual<\/span><span style=\"font-weight: 400;\"> cuando termina el vigente). <\/span><span style=\"font-weight: 400;\">Solo se permite<\/span><span style=\"font-weight: 400;\"> un m\u00e1ximo de tres <\/span><span style=\"font-weight: 400;\">contratos<\/span><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tampoco<\/span> <span style=\"font-weight: 400;\">No<\/span><span style=\"font-weight: 400;\"> se pueden producir dos contrataciones temporales que sumen m\u00e1s de veinticuatro meses <\/span><span style=\"font-weight: 400;\">dentro de<\/span><span style=\"font-weight: 400;\"> un per\u00edodo de treinta meses, <\/span><span style=\"font-weight: 400;\">con<\/span><span style=\"font-weight: 400;\"> la misma empresa o grupo.<\/span><\/li>\n<\/ul>\n<p><b>Si se diera alguno <\/b><span style=\"font-weight: 400;\">de estos casos,<\/span> <b>los trabajadores <\/b><span style=\"font-weight: 400;\">que est\u00e9n trabajando bajo este tipo de contrato<\/span><b> adquirir\u00e1n de forma autom\u00e1tica la condici\u00f3n de trabajadores <\/b><b>indefinidos<\/b> <span style=\"font-weight: 400;\">de la empresa.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En resumen, <\/span><span style=\"font-weight: 400;\">si<\/span><span style=\"font-weight: 400;\"> el convenio colectivo no especifica nada, el <\/span><b>l\u00edmite m\u00e1ximo<\/b> <b>de duraci\u00f3n de un contrato de prestaci\u00f3n de servicios<\/b> <span style=\"font-weight: 400;\">ser\u00e1 <\/span><span style=\"font-weight: 400;\">\u00a0de <\/span><b>tres<\/b><b> a\u00f1os<\/b><span style=\"font-weight: 400;\">. <\/span><span style=\"font-weight: 400;\">Pero,<\/span><span style=\"font-weight: 400;\"> si se acuerda en convenio, <\/span><span style=\"font-weight: 400;\">podr\u00e1 ser de hasta<\/span> <span style=\"font-weight: 400;\">cuatro<\/span><span style=\"font-weight: 400;\"> a\u00f1os.<\/span><\/p>\n<h2>\u00bfC\u00f3mo rescindir un contrato de prestaci\u00f3n de servicios?<\/h2>\n<p><span style=\"font-weight: 400;\">Lo habitual es que<\/span><span style=\"font-weight: 400;\"> el contrato de prestaci\u00f3n de servicios <\/span><span style=\"font-weight: 400;\">finalice<\/span><span style=\"font-weight: 400;\"> o <\/span><span style=\"font-weight: 400;\">se extinga<\/span> <span style=\"font-weight: 400;\">cuando termina<\/span><span style=\"font-weight: 400;\"> el servicio objeto del contrato. <\/span><span style=\"font-weight: 400;\">Pero tambi\u00e9n <\/span><span style=\"font-weight: 400;\">pueden\u00a0 <\/span><span style=\"font-weight: 400;\">c<\/span><span style=\"font-weight: 400;\">ircunstancias que <\/span><span style=\"font-weight:
